Consequences for DUI
In Virginia, a 1st Offense DUI can result in the following:
- Conviction of a Class 1 Misdemeanor
- Up to 12 Months in Jail
- $250 – $2,500 fine
- Suspended Driver’s License
- Ignition Interlock Device in Vehicle
- Probation
- Negative 6 Points on your DMV Record
- Increased Insurance Premiums
- Requirement to Complete the Virginia Alcohol Safety Action Program (VASAP)
In addition to the above consequences, there are harsher penalties when a driver’s blood alcohol content (BAC) exceeds .15. If you are convicted of a DUI with a BAC between .15 and .20, there is a mandatory jail sentence of 5 days. If you are convicted of 1st Offense DUI with a BAC over .20, there is a mandatory jail sentence of 10 days. A 2nd Offense of DUI within five years of a 1st Offense carries a mandatory jail sentence of 20 days. A conviction for 3rd Offense DUI within ten years results in a felony conviction.
