Driving under the influence is a Class 1 Misdemeanor, which can result in up to 12 months in jail and a minimum fine of $250. Many of the penalties for a first offense DUI are dependent on the driver’s blood alcohol level at the time of the offense. If you are convicted of a DUI with a blood alcohol level between .15  and below .20, there is a mandatory minimum jail sentence of 5 days. If you are convicted of 1st Offense DUI with a blood alcohol level over .20, there is a mandatory minimum sentence of 10 days in jail. A 2nd Offense of DUI within five years of the 1st Offense carries a mandatory minimum jail sentence of 20 days. A third conviction of DUI within ten years can result in a class 6 felony conviction.

Other penalties for driving under the influence, driving while intoxicated, or DUI, include probation, a requirement to complete the Virginia Alcohol Safety Action Program (VASAP), and driving for six consecutive months with an ignition interlock device installed in your vehicle. Not only can you be ordered to complete the above requirements, but even low level hits on an ignition interlock device can result in you being brought back to court and required to pay additional fines and serve more time in jail.
