Virginia Criminal Defense FAQ

Can a DUI charge be reduced or dismissed?

Yes, depending on the case. An experienced DUI attorney can challenge field sobriety tests, breathalyzer accuracy, or police procedure violations to seek reduced charges or dismissal.

Virginia has strict DUI laws. A first-time DUI conviction can result in fines, a suspended driver’s license, mandatory alcohol education, and even jail time. Penalties increase with repeat offenses, high BAC levels, or cases involving injury or minors in the vehicle.

If you are arrested or charged with a crime, remain silent and do not answer questions from law enforcement without an attorney present. Contact a criminal defense lawyer immediately to protect your rights and start building your defense.

Virginia classifies drug possession based on drug schedules, with Schedule I and II drugs (such as heroin, cocaine, and methamphetamine) carrying the harshest penalties. A first-time offense for simple possession is usually a Class 1 misdemeanor, punishable by up to 12 months in jail and a $2,500 fine. However, penalties increase for repeat offenses or possession with intent to distribute.

Possession of small amounts of marijuana (up to one ounce) is legal for adults 21 and older, but possession of more than one ounce can result in fines. Additionally, public use, selling marijuana without a license, or possessing larger amounts can lead to misdemeanor or felony charges.

Success Stories

I worked with Brandon on a domestic violence trial and that’s exactly how it felt in the court room with him vs the prosecution. Brandon was playing chess five turns ahead while the prosecution struggled to play checkers. If I could give unlimited stars, I would. Five stars doesn’t do Brandon justice (no pun intended) with how well he worked with me to ease me through the process and help me along in any way he could

Mr. Waltrip listened to our story with sympathy and sensitivity. He was completely realistic and reasonably managed our expectations. Another great benefit was the fact that he lived in and knew the county in which our case was to be heard and he was familiar with both the judge and the opposing counsel. He jabbed, parried, and then closed for a knockout. He left the opposition flummoxed and completely outplayed.
