What are the consequences for a 1st offense DUI in Virginia?

How does BAC level play into your penalty?
If you are convicted of a DUI with a BAC between .15 and .20, there is a mandatory jail sentence of 5 days. If you are convicted of 1st Offense DUI with a BAC over .20, there is a mandatory jail sentence of 10 days. A 2nd Offense of DUI within five years of a 1st Offense carries a mandatory jail sentence of 20 days. A conviction for 3rd Offense DUI within ten years results in a felony conviction.
Can a DUI charge be reduced or dismissed?
Yes, depending on the case. An experienced DUI attorney can challenge field sobriety tests, breathalyzer accuracy, or police procedure violations to seek reduced charges or dismissal.
What’s the difference between DUI and DWI in Virginia?
In Virginia, DUI (Driving Under the Influence) and DWI (Driving While Intoxicated) are used interchangeably. Both refer to operating a vehicle under the influence of alcohol, drugs, or a combination of both that impairs your ability to drive.
What is the legal blood alcohol concentration (BAC) limit in Virginia?
In Virginia, the legal BAC limit is 0.08% for drivers 21 and older. For commercial drivers, the limit is 0.04%, and for drivers under 21, the limit is 0.02% due to the state’s zero-tolerance policy for underage drinking and driving.
